Guarantee terms & conditions
1. Who gives this guarantee
This guarantee is given by DS Home Living Ltd, trading as DS Living, 44a Mill Road, Dewsbury, WF13 2HH. Registered in England & Wales, company number 13055309.
It is in addition to, and does not affect, your legal rights under the Consumer Rights Act 2015. Your mattress must be of satisfactory quality, as described and last a reasonable time. If it is faulty, you may be entitled to a refund (within 30 days), a repair or replacement, or a price reduction, whatever this guarantee says and even after it has ended. Nothing in these terms limits those rights. Citizens Advice (0808 223 1133) can explain them.
2. What is covered
- Standard: every DS Living foam mattress is guaranteed against manufacturing defects for 1 year from delivery.
- Extended: register within 30 days of delivery on this page and the guarantee extends to 5 years from delivery, free of charge.
A manufacturing defect is a fault in materials or workmanship that stops the mattress giving the support it was designed to give. Only these count:
- a permanent dip or body impression deeper than 3cm, measured as set out in section 6;
- foam that has split, crumbled or broken down;
- a cover seam or zip failing in normal use (cover faults are covered for the first 12 months only).
3. What is not covered
Feel and normal change
- Comfort preference. Finding the mattress too firm, too soft, too warm or too cool is not a defect.
- Normal settling. Foam softens slightly with use, and body impressions of up to 3cm are normal and expected.
- A slight smell when new, and the time a rolled mattress takes to reach full size.
Damage caused by
- An unsuitable base: slats more than 7cm apart; a broken, sagging or uneven base; or a base not designed for the mattress size.
- Misuse: standing, jumping or kneeling on the mattress; folding, bending or crushing it; or using it on the floor or on a sofa bed.
- Weight above the recommended maximum user weight for the mattress (see section 8).
- Leaving a rolled mattress in its packaging for more than 14 days after delivery.
- Not rotating the mattress head to foot every 3 months, where that is the cause of uneven wear.
- Stains, soiling, liquids, burns, tears, pets or mould. For the health and safety of our staff we may assess heavily soiled mattresses from photos only and may decline to collect them. This does not affect claims for faults that are unrelated to the soiling. We strongly recommend a mattress protector.
- Normal wear to the cover, such as bobbling or fading.
Mattresses that are not eligible
- The law label (fire safety label) has been removed.
- Used commercially or away from a private home, for example rental properties, HMOs, holiday lets, hotels, care homes or student accommodation. These get the 1-year guarantee only.
- Bought second-hand, from anyone other than DS Living or an official DS Living store, or sold as ex-display, seconds or clearance where this was stated at the time of sale.
- Spring mattresses and toppers, which have our 1-year guarantee.
4. Conditions
- Original buyer only. The guarantee cannot be transferred.
- Registration must be completed within 30 days of delivery, using the order number and the email address on the order. Late registrations get the 1-year guarantee only.
- Proof of purchase (your order number) is needed for every claim.
- Mainland UK private homes only.
- Report a problem within 14 days of noticing it, and within the guarantee period.
- Keep the mattress until we have decided your claim. Do not dispose of it unless we ask you to.
- Accurate information. We may refuse a claim if information or photos given to us are false or misleading.
5. What we will do
If we accept a claim, we will repair or replace the mattress or the faulty part, at our choice, at no cost to you, for the full 5 years.
- If the same model is no longer available, we will supply one of equal or similar specification.
- We will either collect the faulty mattress or ask you to dispose of it responsibly after we have the photos we need.
- A replacement is covered for the rest of the original guarantee period only. It does not start a new guarantee.
Under this guarantee the remedy is repair or replacement. Your legal rights to a refund or price reduction are not affected. This guarantee does not cover the cost of bedding or bases, time off work, or other indirect loss, except where the law says we are responsible.
6. How to claim
Email [email protected] with:
- your order number;
- clear photos of the whole mattress, the law label and the problem;
- a photo of the base the mattress is used on;
- for a dip or impression: remove all bedding and leave the mattress unoccupied for 1 hour; lay a straight edge (such as a broom handle) across the dip, and photograph a ruler measuring the gap at its deepest point.
We may ask to inspect the mattress in photos, by video call or in person before deciding. If we collect a mattress and find no manufacturing defect, or find damage that this guarantee does not cover, we may charge the collection and redelivery cost. We will always tell you this cost before arranging collection.
7. Changes
These terms apply to mattresses delivered from 10 October 2026. Mattresses delivered before then are covered by the terms in place at the time of purchase. You can ask us for a copy of these terms in writing or by email at any time.
